1 Plaintiff in error, Calvin J. MeGown, defendant below, was charged by information in the County Court of Okmulgee County, Oklahoma, with the offense of operating a motor vehicle while under the influence of intoxicating liquor, allegedly committed in said county on or about December 1, 1953. He was tried by a jury, convicted, and his punishment set at ten days imprisonment in the county jail and a fine of two hundred and fifty dollars. Judgment and sentence were entered accordingly, from which this appeal has been perfected.
